Terms of Use for the MawisUtility Service

I. INTRODUCTORY PROVISIONS

  1. These General Terms and Conditions of HRDLIČKA spol. s r.o., ID No. 186 01 227, with its registered office at náměstí Kněžny Ludmily 45, Tetín, Postal Code 266 01, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, File 4062 (hereinafter referred to as the “Company”)

    define the mutual rights and obligations of the contracting parties arising in connection with or based on the use of the MawisUtility service.
  2. For the purposes of these Terms and Conditions, a “Customer” means the recipient of the MawisUtility Service provided by the Company, which the Customer may use for a fee as a registered user or free of charge through public access.
  3. The company reserves the right to amend or supplement these terms and conditions as necessary

II. SERVICE DESCRIPTION

  1. The product provided by the Company refers to the MawisUtility service, which consists of generating and sending requests to technical infrastructure entities for their opinion on the possible existence of technical infrastructure in a specific area defined by the Customer. Requests are generated for technical infrastructure entities that the requester has confirmed in advance via the application, which is available to the Company’s Customers after they register and log in to their customer account on the mawis.eu Portal. (For more information on registering and logging in to a registered account, see the MAWIS Terms and Conditions) or via public access.
  2. The Customer acknowledges that some technical infrastructure entities do not accept electronic requests generated through the MawisUtility application. The Customer is informed of these cases during the application submission process (Step 3: TI ENTITIES) and also in the generated report. Such a request for the specified technical infrastructure entity will be sent to the Customer via email for printing, and the Customer shall be responsible for ensuring its delivery to the relevant technical infrastructure entity at their own expense.
  3. The customer acknowledges that the list of technical infrastructure entities generated by the MawisUtility service is for informational purposes only and that the Company does not guarantee its completeness. The Company undertakes, in cooperation with the relevant building authorities, to maintain the most up-to-date data possible; however, the builder must still comply with their legal obligations under the Building Act regarding the acquisition of zoning/building permits, etc.
  4. The Company is not responsible for the processing of requests generated and sent by technical infrastructure entities, nor for any fees associated with the issuance of statements, which fall entirely within the purview of such entities. The Company acts solely as an intermediary that generates and, in some cases, distributes requests for statements regarding the potential existence of technical infrastructure in a specific area designated by the customer.
  5. Customers log in to the service using a registered account with a valid license (after purchasing the product) or via public access, where the service is available through the following entry point:

    a) A registered account is intended for professionals who use the service for their profession (business) or for other customers for whom public access is insufficient. The customer selects the number of submissions and functionality at the time of purchase. A registered user can submit applications throughout the entire Czech Republic. After the license expires or the submission limit is reached, the user can repurchase the product and continue using the service.

    b) Public access is intended for citizens and the general public who use the service to carry out their own construction projects. Submissions via an entry point are limited to the territory of the relevant building authority under the city/municipality/ORP or region that has established the service for its citizens. The service is provided free of charge for 3 bulk submissions in a given calendar year and at a given entry point. Subsequently, the user account is blocked, and the user may create a registered account or wait for the account to be restored in the following calendar year.
  6. The Company may suspend a customer account, particularly if the Customer has not used it for more than 12 months. Furthermore, if the Customer breaches their obligations under the contract (including the Terms and Conditions), which includes providing false or incorrect information during registration or when updating such information. For the purposes of this document, the preceding sentence means that the Company may also block the account or revoke relevant access to users who repeatedly fail to complete an application and misuse data from the Register of Technical Infrastructure Entities (RSTI) for their private or business purposes. This data is the property of the Company, and its misuse is in violation of these terms and conditions.

  7. The company undertakes to maintain a telephone hotline for customers to address their inquiries, available from 8:00 a.m. to 4:00 p.m. on weekdays, excluding national holidays. Customers may also direct their questions regarding purchases, products, or services to the following email address: info@mawis.eu.
  8. The customer acknowledges that when using the MawisUtility service, their personal data will be handled as specified in the Terms of Use for the web interface.

III. CONCLUSION OF THE CONTRACT AND PRODUCT PRICE

  1. The price of the service, including VAT, is always listed for each specific product in the shopping cart on the mawis.eu portal or is available upon request from a sales representative of HRDLIČKA spol. s r.o.
  2. The company may adjust prices from time to time or offer discounts on products in the form of coupons at its discretion. Current prices are always listed with the product.
  3. In the shopping cart, the prices of the Company’s services (products) are calculated based on the type of license purchased by the Customer, the selected features, and the number of submissions the Customer purchases on the Portal operated by the Company.
  4. The price for the product selected by the Customer and added to the shopping cart can be paid via the GoPay payment gateway or by bank transfer.
  5. In the case of payment by bank transfer, the Company will issue a pro forma invoice to the Customer. The Company will issue a tax document—an invoice—to the Customer after payment of the Service price and will send it electronically as part of a notification email stating that the order has been completed, the Service has been paid for, and the relevant application can now be used. The Company is a value-added tax payer.
  6. Information about the purchased product, including the corresponding number of submissions credited, is displayed after logging in to the MawisUtility service in your user profile under the “My Account” tab.
  7. The contract is entered into for a fixed term—depending on the type of license. Any unused submissions that the Customer purchased as part of the transaction will expire upon the expiration of the license term, and no refund will be provided for them. The Customer will be notified of this expiring term before the one-year period from the date of purchase expires.
