Pre-contractual information for consumers

within the meaning of Sections 1811 and 1820 of Act No. 89/2012 Coll., the Civil Code, as amended

  2. Description of Services Provided and Their Key Features
    The Company provides its Customers with services (products) on the mawis.eu Portal, each of which supports the activities of other customers and therefore has different functionalities and features. Customers can view a detailed description of how each of the offered services works and what it is used for directly on the product pages.
    All services (products) are available to the Company’s customers after registration, logging into their customer account on the mawis.eu Portal, and purchasing the service via the shopping cart. A “Customer” is defined as the recipient of a Service provided by the Company, which the Customer obtains from the Company in exchange for monetary consideration.
  3. Service price, including taxes and fees.
    The price of the Company’s services, including value-added tax, is always listed for specific services (products) in their price list, which is available on the mawis.eu portal.
    In the shopping cart, the prices of the Company’s services (products) are calculated based on the type of license purchased by the Customer, the selected features, the validity period, and the number of submissions the Customer purchases in the shopping cart operated by the Company.
  4. Payment Method and Terms of Delivery
    The price for the product selected by the Customer and added to the shopping cart is payable solely and exclusively via the GoPay payment gateway or by bank transfer.
    In the case of payment by bank transfer, the Company will issue a pro forma invoice to the Customer. The Company will issue a tax document—an invoice—to the Customer after payment of the Service price and will send it electronically as part of a notification email stating that the order is complete, the Service has been paid for, and the relevant service (product). The Company is a value-added tax payer.
    After payment is made, the Customer may use the service (product) they have purchased.
  5. Rights Arising from Defective Performance and Rights Arising from Warranties
    Rights arising from defects in services are governed by the general provisions of Act No. 89/2012 Coll., the Civil Code, as amended, in particular the provisions of Section 1914 of Act No. 89/2012 Coll., the Civil Code, which forms the basis for all rights arising from defective performance, Section 1923 of Act No. 89/2012 Coll., the Civil Code, as amended, and Section 1921(1) of Act No. 89/2012 Coll., the Civil Code. Act No. 634/1992 Coll., on Consumer Protection, shall also apply in cases where the Customer is a consumer.
    Further details regarding complaints, the recommended procedure for the Customer when filing a complaint, and the Company’s procedure for resolving it can be found in these Complaint Rules.
  6. Term of the Agreement and Conditions for Termination of the Obligation
    Contractual relationships regarding the Company’s services come into effect upon payment of the price for the selected services to the Company’s account, specifically at the moment the Customer receives a notification email at the email address provided by the Customer stating that the order for the services has been completed and the Customer can access the purchased service (product).
    The Company uses these General Terms and Conditions to enter into a purchase agreement. A template can be found in the Consumer Information on the Right to Withdraw from the Contract.
  7. Out-of-Court Complaint
    Resolution The Czech Trade Inspection Authority, with its registered office at Štěpánská 567/15, 120 00 Prague 2, ID No.: 000 20 869, website: coi.cz. The online dispute resolution platform located at ec.europa.eu/consumers/odr may be used to resolve disputes between the Customer and the Company.

This Pre-Contractual Information for Consumers is valid and effective as of January 1, 2023.
