Terms of Use for the MawisGeoportal Service 

I. INTRODUCTORY PROVISIONS 

  1. These Terms of Use for the MawisGeoportal service (hereinafter referred to as the “Terms”) govern the rights and obligations of the Provider and the User in connection with the use of the MawisGeoportal service (hereinafter referred to as the “Service”), provided via the MAWIS platform. 
  2. The service is part of the MAWIS platform and is provided as SaaS (Software as a Service), i.e., as software accessible via remote access without the transfer of ownership rights to the source code. 
  3. These Terms and Conditions are specific terms and conditions for the Service and supplement: 
  4. Unless otherwise provided in these Terms and Conditions, the documents listed above shall apply. 
  5. In the event of any conflict, these Terms and Conditions shall prevail with respect to the MawisGeoportal Service. 
  6. By beginning to use the Service (including trial access), the User confirms that they have read and agree to these Terms. 
  7. The Service is intended primarily for public administration entities, designers, builders, technical infrastructure managers, and other professional users who utilize the Service as part of their business or professional activities. 

II. SERVICE DESCRIPTION 

  1. MawisGeoportal is a web-based mapping application that primarily allows users to: 
    • display of geospatial data, 
    • working with map layers, 
    • data management and editing (to the extent specified in the agreed License), 
    • integration of external map services (e.g., WMS), 
    • Export selected data and map outputs. 
  2. The service may include the following functional components in particular: 
    • Geoportal – for technical infrastructure managers and municipalities, 
    • DTM networks for builders, 
    • Record of the applicant's requests. 
  3. The scope of functionality is determined by the type of license agreed upon between the Provider and the User. 
  4. The service may allow users to view or edit data, depending on their assigned roles and permissions. 

III. CONCLUSION OF THE CONTRACT AND PRODUCT PRICE 

  1. Access to the Service is available only to registered Users via the MAWIS Identity (IDM) system. 
  2. The user can: 
    • take advantage of a 30-day trial (demo account), or 
    • Purchase an annual license for the Service through the MAWIS platform. 
  3. The license is activated after: 
    • proper registration, 
    • upon payment of the price, 
    • administrative assignment of the License by the Provider. 
  4. The license price is listed on the MAWIS website or is negotiated on an individual basis. 
  5. Payment can be made via a payment gateway or by bank transfer. 
  6. The license is granted for a fixed term, typically 12 months, unless otherwise agreed. 
  7. Once the License period has expired, access to the Service may be restricted or deactivated. 

IV. USER ACCOUNTS AND ROLES 

  1. User accounts are managed through the MAWIS IDM system. 
  2. The user is responsible for: 
    • the accuracy of the information provided, 
    • protecting your login credentials, 
    • all activities performed under your account. 
  3. The Provider is entitled to restrict or block access to the Service, particularly in the following cases: 
    • a breach of these Terms, 
    • misuse of the Service, 
    • failure to pay the license fee, 
    • security risk. 

V. CUSTOMER DATA AND DATA MANAGEMENT 

  1. If a user requests the inclusion of their own data (e.g., local road inventories, traffic signs, street lighting, green spaces, cemeteries, waste management, etc.), such data is processed on the basis of a separate, individual order. 
  2. Uploading customer data is not included in the standard license. 
  3. The user is responsible for: 
    • the accuracy and completeness of the data provided, 
    • their relevance, 
    • the authority to handle them. 
  4. The service may allow exports primarily in the following formats: 
    • XLSX/XLS, 
    • PDF, 
    • PNG, 
    • JPEG. 
  5. The service may allow the following temporary actions during a user session: 
    • import of selected file formats (e.g., SHP, DGN, DWG), 
    • Connecting external map services. 
  6. The provider does not guarantee full compatibility of all data formats. 

VI. LIMITATION OF LIABILITY FOR THIRD-PARTY DATA 

  1. The service may use third-party data and mapping services, in particular those provided by the Czech Office for Surveying, Mapping and Cadastre, such as 
    • Land Registry (KN), 
    • Real Estate Identification and Address Registry (RÚIAN), 
    • Digital Technical Map of the Czech Republic (DTM), 
    • orthophoto maps, other publicly available WMS services. 
  2. Provider: 
    • has no control over the content or availability of these services, 
    • does not guarantee their accuracy, timeliness, or completeness, 
    • is not liable for any outages, slowdowns, or technical errors. 
  3. An outage of external services may cause: 
    • temporary unavailability of map layers, 
    • restrictions on certain features of the Service, 
    • inability to generate outputs or requests. 
  4. The provider is not liable for any damages resulting from the unavailability or inaccuracy of third-party data. 

VII. SERVICE AVAILABILITY AND TECHNICAL LIMITATIONS 

  1. The Provider is entitled to carry out scheduled downtime or temporarily restrict the operation of the Service for technical reasons. 
  2. The Provider does not guarantee that the Service will be available 24/7 without any downtime. 
  3. The use of the 3D scene is subject to the technical limitations specified in the document “Limitations on Data Display in the 3D Scene.” 
  4. The functionality of the Service may be affected by the technical specifications of the User’s device and the quality of the internet connection. 

VIII. NATURE OF THE OUTPUTS 

  1. The service provides information and support tools for working with data. 
  2. The outputs from the Service do not replace: 
    • binding decisions by public authorities, 
    • official documentation, 
    • legally binding documents. 
  3. The user is responsible for how the output from the Service is used. 

IX. AMENDMENTS TO THE TERMS AND CONDITIONS 

  1. The Provider reserves the right to modify or amend these Terms and Conditions. 
  2. The User will be notified of any changes to the Terms and Conditions in an appropriate manner via the MAWIS platform. 
  3. The amended Terms and Conditions take effect on the date of their publication.
