I. INTRODUCTORY PROVISIONS
- These Terms of Use for the MawisTools service (hereinafter referred to as the “Terms”) govern the rights and obligations of the Provider and the User in connection with the use of the MawisTools service (hereinafter referred to as the “Service”), provided through the MAWIS platform.
- The service is part of the MAWIS platform and is provided as SaaS (Software as a Service), i.e., as software accessible via remote access without the transfer of ownership rights to the source code.
- These Terms and Conditions are specific terms and conditions for the Service and supplement:
- Unless otherwise provided in these Terms and Conditions, the documents listed above shall apply.
- In the event of any conflict, these Terms and Conditions shall prevail with respect to the MawisTools Service.
- By beginning to use the Service (including trial access), the User confirms that they have read and agree to these Terms.
- The Service is intended primarily for surveying firms, designers, technical professionals, and other entities that use the Service as part of their business or professional activities.
II. SERVICE DESCRIPTION
MawisTools is a suite of specialized online tools designed for processing and analyzing geospatial data, land registry data, CAD drawings, and other public data sources.
The service may include, in particular:
- Tools for working with land registry data
- searching for the relevant parcels,
- searching for the relevant soil blocks,
- Bulk view of owners,
- A comparison of the status of the real estate cadastre over time.
- Calculations and analyses of spatial data
- 3D volume calculation,
- surface model,
- statistics on the content of CAD drawings.
- Data Format Conversions
- conversion of JVF DTM files to DGN/SHP,
- conversion of SHP files to DGN,
- Conversion of DGN files to DXF, KML, SHP, and other formats.
- The service enables automated processing of input data and the generation of outputs depending on the type of tool used.
- The range of available tools and the number of times they can be used depends on the type of license purchased.
III. CONCLUSION OF THE AGREEMENT AND LICENSE
- Access to the Service is available only to registered Users via the MAWIS IDM system.
- The user can:
- use a demo account for 30 days, or
- purchase an annual license.
- The license includes a set number of credits that the User uses each time the tools are launched.
- The license is activated administratively after payment has been received.
- The license price is listed on the MAWIS website or is negotiated on an individual basis.
- Once your credits have been used up or the License period has expired, access to the Service may be restricted.
Demo account:
- The Provider may grant the User trial access to the Service in the form of a demo account for a period of 30 days.
- The demo account is intended solely to familiarize you with the Service and to verify its suitability for your intended use.
- The provider is generally entitled to provide a demo account only once per business entity or organization, unless otherwise expressly agreed.
- For the purpose of assessing eligibility for a demo account, the Provider is authorized to review, in particular, the company name, business identification number (BIN), contact information, email addresses, phone numbers, and other information provided during registration or when placing an order.
- The provider reserves the right to reject a request for a demo account if:
- a demo account has already been provided to the same business entity or organization,
- there is reasonable suspicion of circumvention of the rules governing the provision of demo accounts,
- incomplete, false, or misleading information was provided during registration.
- In exceptional cases, the Provider may decide to provide a replacement demo account, particularly in the event of a significant expansion of the Service’s functionality, the addition of new tools, or for other business or technical reasons.
- Unless otherwise agreed between the Provider and the User, a user account is created by default for the person listed on the order or for the person listed as the contact person on the tax invoice.
- The Provider reserves the right to restrict, suspend, or cancel a demo account at any time in the event of a violation of these Terms or misuse of the trial access.
IV. DATA PROCESSING
- Users may upload their own data to the Service to the extent permitted by the specific tool.
- The format and limits of the input data are defined for each tool.
- Recorded data:
- are not stored by the Provider for an extended period of time,
- is intended for one-time use only,
- are not shared with third parties.
- The provider is not liable for the content, accuracy, or legal compliance of the input data.
- The user is responsible for ensuring that they are authorized to use the uploaded data.
V. NATURE OF THE OUTPUTS
- The outputs from the Service vary depending on the tool used and may be available in the following formats, among others:
- XLSX/XLS,
- TXT,
- SHP,
- DGN,
- DWG.
- The accuracy of the results depends on:
- the quality and accuracy of the input data,
- compliance with the tool's defined limits (input formats and conditions).
- If the analysis or conversion is performed without any technical errors, the results will correspond to the algorithm and specifications of the tool in question.
- If a technical problem arises, the User may contact customer support.
VI. LIMITATION OF LIABILITY
- The user is responsible for how the results are used in the course of their professional activities.
- The provider is not liable for any damage resulting from the improper use of the output or from the use of the output contrary to its intended purpose.
- The Provider shall not be liable for any damages resulting from a possible infringement of the licensing rights to the data used by the User.
VII. SERVICE LIMITS
- Each tool has defined limits:
- size of input files,
- data format,
- performance limitations.
- The number of times the tools can be run is limited by the number of credits specified in the License.
- Automated scraping or abuse of the Service through scripts or other automated means is prohibited.
VIII. SERVICE AVAILABILITY
- The Provider is entitled to perform scheduled maintenance or temporarily limit the availability of the Service for technical reasons.
- The Provider does not guarantee that the Service will be available 24/7 without any downtime.
IX. AMENDMENTS TO THE TERMS AND CONDITIONS
- The Provider reserves the right to modify or amend these Terms and Conditions.
- The amended Terms and Conditions take effect on the date of their publication on the MAWIS platform.
